In 1809, Alexander Cloudsly (spelling at the time) entered a form of marriage contract with his second wife Jean Welsh, and appears in his testament on death of 1840. Here is a transcription (formatting lost, but page numbers shown in original book of testaments):

Esquire Commissary Depute of the Commissariot of Kincardineshire Compeared John Brand and Alexander Burnett Waiters in Stonehaven as procurators and gave in the Inventory and oath thereon underwitten disiring that the same might (along with a document titled “Article of agreement between Alexander Cloudsly and Jean Welsh drawn up previous to their Marriage, the second day of June in the year eighteen hundred and nine and another document titled “Additional Articled of agreement between Alexander Cloudsly and Jean Welsh previous to their marriage) be inserted and registered in the Commissary Court Books of said shire and of which Inventory the principal being written on paper denoting a Stamp duty of five pounds Sterling the tenor follows Vis:

Elizabeth Cloudsly or Low Wife of the Depondent. Daughters of the said Defunct
entered upon the possession and Management of the Deceaseds personal
Estate as Executors Dative qua nearest in kin to him the said Deceased for
behoof of themselves and all others having interest, decerned by the said
Commissary of Date the thirtieth day of April last; - That the Deponent does not
know of any Settlement or Writing relative to the disposal of the deceaseds
personal Estate or effects or any part of them other than a document titled
“Articled of agreement between Alexander Cloudsly and Jean Welsh drawn up
previous to their marriage, the second day of June in the year eighteen hundred
and nine” and another document between Alexander Cloudsly and Jean Welsh
“previous to their marriage,” which signed by the Depondent and said Commissary
of this date as relative hereto. That the

foregoing Inventory which is signed by the Deponent and the said Commissary
of this date as relative hereto is a full and complete Inventory of the Personal
Estate and effects of the said deceased wheresoever situated, already recovered,
or known to be exiting, belonging or due to him beneficially at the time of his death;
and that the said Estate situated in Scotland is of the value of three hundred

At Stonehaven the Seventh day of May in the year One thousand eight hundred and forty in presence of Hugh Fullerton Esquire Commissary Depute.

Depute of the Commessariot of Kincardine there Compeared John Brand and Alexander Burnell Writers in Stonehaven as procurators and gave in the articles of Agreement underwritten between the therein designed Alexander Cloudsly and Jean Welsh, craving that the same might (along with an Inventory of the Defunct personal Estate) be inserted and registered in the Commissary Court Books of said Shire; which request the said Commissary Depute finding to be reasonable ordained the same to be done accordingly; and of which the principal being written on unstamped paper the tenor follows Vizt. Articles of agreement between Alexander Cloudsly and Jean Welsh drawn up previous to their marriage the second day of June, in the year one thousand eight hundred and nine.

1st Jean Welsh shall allow whatever property she brings with her at Marriage to be united to Alexander Cloudsly’s stock.
2nd The Children of Jean Welsh by her former husband shall retain and enjoy

the portions to which they are entitled out of the property of their late father Robert Greig.
3 If Alexr Cloudsly die before his Wife Jean Welsh, She shall receive back whatever property she brought with her, then there shall be one hundred and twenty pounds set apart to be equally divided among his three children by former marriage provided his son do not succeed to his lease. The remaining property of Alexander Cloudsly after paying his lawful debts to be equally divided between his widow Jean Welsh and his family by first marriage.
4 If Jean Welsh have children to her husband Alexander Cloudsly then she shall if she survive him, receive back at his Death what property she brought with her at marriage and the remaining Property belonging to Alexr Cloudsly including the 120 Pounds above specified shall be equally divided between his family by his former wife and Jean Welsh and her family.

The above articles were written at the [desue] and with concurrence of Alexander Cloudsly and Jean Welsh the parties concerned by me John Glennie Assistant Minister of Garvock and should any of the articles be thought obscurely or inaccurately stated reference is hereby made to a separate Stamped Deed of Settlement which both the parties bind themselves to get regularly drawn up by a Notary Public or some person properly qualified to write such a paper. If Jean Welsh survive Alexander Cloudsly she shall be entitled to a house and two acres of ground and also, the said two acres of ground shall be laboured by the person in possession of the Farm, and the cow shall go with the farmer’s Cattle, during what remains to run of the Lease at the time of Alexander Cloudsly’s decease.
